No 1 Fertility is committed to providing you with care and quality services. This policy outlines our ongoing obligations with the management of your personal information.

No 1 Fertility are governed by the Privacy Act 1988 (Cth) (“Privacy Act”) and by other applicable privacy legislation including the Health Records Act 2001 (VIC) and the Health Records and Information Privacy Act 2002 (NSW) (collectively, “Privacy Laws”).

  1. What is Personal Information and why do we collect it?

Personal Information includes information or opinions which can reasonably identify an individual. Examples of personal information we may collect include names, birthdates, addresses, email addresses, phone, relevant medical information, other information that may be necessary to safely support your care and help us to deliver services to you.

Personal information is obtained in various ways including directly from you in consultations, interviews, written correspondence, telephone, email, website www.number1fertility.com and from third parties. We may also generate personal information about you in the context of interacting with you or providing services to you.

We collect your personal information for the following purposes:

  • Providing care / health services to you.
  • Disclosing your personal information to others involved in the provision of care / health services to you, such as medical practitioners, pathology labs, and other health services providers.
  • Quality assurance.
  • Other purposes which are directly related to the provision of products and services to you and which you would reasonably expect (e.g. disclosure of our personal information to its related entities and third parties which are involved in the management or provision of the health services provided to you or who provide services to you in connection with the purposes stated here).
  • Approved research, in strict compliance with the Privacy Laws and other applicable laws.
  • To meet our legal and contractual requirements and obligations.
  • Other purposes which are otherwise authorised or required by law.
  • Our internal business purposes of such as administrative planning, service development and improvement, billing and other internal purposes related to the management and administration of our business.
  • Responding to website inquiries and other communications from you.
  • Contacting you or your nominated emergency contact in case of an emergency.
  • Contacting you for marketing purposes (if you have consented to marketing).
  • To establish, exercise or defend our legal rights, such as in the event of a legal claim or complaint, or for the purpose of legal proceedings.
  • When it is necessary to lessen or prevent a serious threat to a patient’s life, health or safety or to public health or safety (including, but not limited to, where it is impractical to obtain the patient’s consent).

We will not use your personal information for marketing any of our products or services directly to you without your consent.

  1. What Personal Information do we collect and hold?

The information we may collect and hold about you may include but is not limited to:

  • Demographic information and contact details including full name, date of birth, age, sex at birth, address, telephone number, email address, credit card details.
  • Health fund details, government issued identifiers including Medicare number, driver’s licence or passport for identification and claiming purposes.
  • Medical / health information including yours and potentially your family’s / partner’s medical history, medications, allergies, adverse events, immunisations, social history, and risk factors.
  • Audio recordings and transcripts of telephone conversations and webchat communications (we will always seek your prior consent to do this).
  • Clinic camera surveillance footage (CCTV camera footage for safety purposes only).
  1. How do we collect and hold your Personal Information?

We collect, generate and hold your personal information in various ways, including but not limited to:

  • When you visit our website, send us an email or SMS, telephone us, make an online appointment or otherwise communicate with us in any way, requesting further communication (inclusive using social media).
  • When you make your first appointment or register with us electronically, we will collect your personal information via your registration.
  • During your patient journey with us, we may collect further personal information.

In some circumstances, personal information may also be collected from other sources, as it may not be practical or reasonable to collect it from you directly. This may include information from:

  • Other relevant healthcare providers (as per consent).
  • Your health fund, Medicare, or the Department of Veterans’ Affairs.
  • Your family / partner.

No 1 Fertility may record phone calls for quality and training purposes and to maintain the safety and security of our staff and patients. We will always seek your consent at the beginning of the phone call. Phone call recordings are routinely permanently deleted.

  1. With whom do we share your Personal Information?

We may share your personal information for the purposes stated in section 1 of this policy:

  • With third parties who work with our practice, such as accreditation agencies and contractors who support (directly or indirectly) the delivery and / or management of our services (e.g. billing / administrative support).
  • With other healthcare providers (e.g. medical practitioners and pathology labs).
  • Third party payers, such as Medicare and private health insurers.
  • 1 Fertility’s professional advisers.
  • Other external parties where required or authorised by law.
  1. Disclosures outside of the State / Territory of collection or outside of Australia

We may transfer to, disclose, and store your personal information outside the State / Territory of original collection and outside Australia, including:

  • The United Kingdom.
  • The United States of America.

Where we transfer your personal information, we will always take reasonable steps to ensure such recipients protect personal information they receive in a way that is consistent with how such information is required to be protected by us in Australia under the applicable Privacy Laws.

  1. How do we store and protect your Personal Information?

We endeavour to take every reasonable step to ensure your personal information is secure.  Some of the measures we use include encryption enabled electronic storage, password protections, data security breach risk mitigation processes and confidentiality agreements with staff and contractors. 

No 1 Fertility complies with applicable Privacy Laws.

  1. How can you access and correct your Personal Information held with us?

You have the right to request access to, and update, your personal information.

We acknowledge you may request access to your medical records. A written request in the form of a completed consent to release medical information will be required. Please contact us at hello@number1fertility.com. We are obliged to action this request within 30 days. There are exceptional circumstances where access may be denied under the Privacy Act or other government regulation or legislation.

We will endeavour to take all reasonable steps to keep your personal information current and accurate, but we also rely on you to inform us of any changes to your personal information or any significant changes to your circumstances that affects your receipt of our services (e.g. change of contact details, change of relationship status, etc.). Requests to update your information can be forwarded to hello@number1fertility.com.

We take complaints and concerns regarding privacy seriously. Any concerns should be forwarded in writing to
